Designer Sofas 4u - Terms and Conditions of Trading

Designer Sofas 4u and its affiliates provide services to you subject to the following conditions. By visiting or shopping at Designer Sofas 4u, you agree to these terms. Please read them carefully. When you use any Designer Sofas 4u service or purchase from any business affiliated with us, you will also be subject to the applicable terms and conditions for that service or business. Additional terms and conditions apply to online sales, as set out in Clause 9.

1. Product Specifications

1.1 We have a policy of continuous product development and reserve the right to amend specifications and prices without notice for future sales.

1.2 Goods supplied may vary slightly from those on display or advertised. Any significant variations will be highlighted, and the goods supplied will be of equivalent value, functionality, and appearance unless otherwise agreed.

1.3 Some furniture is made from natural wood, which may mellow with age and exposure to sunlight.

1.4 Leather goods are made from natural leather and may not be uniform in colour or texture. Marks and scars are natural characteristics of high-quality leather. Variations due to age, sunlight, or heat exposure are normal.

1.5 We aim to match the fabric or leather colours as closely as possible to the samples chosen, but variations may occur. We recommend requesting samples for colour matching, as screen resolutions can vary. We are not liable for claims based on colour differences if a sample has not been requested.

1.6 Some products may require self-assembly. We do not offer assembly services.

1.7 Please note images are for illustration purposes only.

2. Measurements

2.1 You are responsible for ensuring that furniture will pass freely into the desired room. Delivery ends at the kerbside, though the delivery team may assist in moving furniture into your room at your own risk.

2.2 Delivery charges do not include the removal of doors, windows, or other fixtures unless specifically stated on your order form.

2.3 Custom measurements provided by customers for bespoke sofas are used at their own risk. We may alter these slightly if necessary to ensure quality. We are not responsible for measurement errors made by customers.

2.4 Since all items are made to order, slight variations in measurements may occur. All dimensions are approximate.

3. Prices

3.1 All prices are in GBP and include VAT at the prevailing rate. Prices may change without notice, but we will only alter the price after confirming your order.

3.2 If prices are seen in other currencies (€/$), payments will still be processed in GBP, and any currency conversion charges will be borne by you.

4. Payments

4.1 For most goods, a 30% non-refundable deposit is required for bespoke orders. Some goods may require full payment at the time of purchase.

4.2 You will be contacted with an estimated delivery date. Any remaining balance must be paid before delivery.

4.3 If payment is not made in full before delivery, the outstanding amount will be passed to a third-party debt collector, incurring administrative fees and commissions, payable by you.

5. Delivery

5.1 If collecting, you must do so within 14 days of receiving notification that your order is ready. If not, storage fees will apply, payable in advance. After two months, your order may be cancelled, and the balance refunded minus the non-refundable deposit and storage charges.

5.2 We deliver on weekdays to UK mainland addresses. Delivery inside the property is at the discretion of the driver and at your own risk. A two-person team handles standard deliveries.

5.3 Changes to your order may impact the delivery date.

5.4 If you are unable to accept delivery on the confirmed date, we may charge for subsequent deliveries. Redelivery / new date may take up to 4-6 weeks.

5.5 You are responsible for providing safe access for delivery. If access is unsafe, goods may be left at a safe location. Parking permits must be provided in advance if required.

5.6 If delivery is unsuccessful due to unsafe access, the goods may be left in a safe place, or your order may be cancelled. A refund will be processed minus the 30% non-refundable deposit and delivery charges.

5.7 In case of accidental damage during delivery, our liability is limited to repair or replacement. If repair or replacement is unsuitable, a refund may be offered.

5.8 Time of delivery is not of the essence. We will not be liable for any loss of profits or other financial loss due to delivery delays caused by circumstances beyond our control.

5.9 Additional charges apply for deliveries requiring special equipment or involving non-ground-floor access.

5.10 Delivery to certain postcodes may have longer lead times.

5.11 For all 'International Orders' we will not be held responsible for any damages that may occur during transit if you have not requested Transit Insurance.  It is your responsibility to check for damages before signing the Proof of Delivery.

5.12 Delivery to the following postcode areas may attract a slightly longer delivery lead-time: IV, AB, KY, DD, PH, PA, TR, EX, PL, TQ, DT, BH, SO, PO, BN, CT, GU, RH, TA.

5.13 Delivery Crews are forbidden to remove any safety clothing, PPE and Footwear

5.14 Its the recipients resposibility to cover all flooring/walls to the delivery point. No claims can be made for damage caused to unprotected floors and walls

5.15 It is the Recipients responsibility to remove all personal objects which may be breakable or cause obstruction en-route to the desired delivery point (ornaments, pictures, tariling wires etc.  No claim can be made if damaged by delivery crew

5.16 It is the recipients responsibility to ensure the item willl fit through doorways and hallways and can be physically manouvered through  

5.17 If the delivery person feels that the item cannot be physically manouvered without causing damage to the property, they will inform the recipient and leave the furniture in a safe room of the property

5.18 In the event of leaving the furniture in a safe room, the items will need to be checked, as no responsibility will be taken for subsequent damages

5.19 It is the recipients responsibility if they insist on having an item moved to their room of choice, when informed by delivery persons that it is not possible to manoeuvre item without possibly causing damage to the property and/or furniture. The company will not take responsibility for damage caused. We are only able to deliver to the ground floor and 1st floor as long as that has the first flight of stairs with an easy access.

5.20 If the recipient requests packaging to be removed, it is at their own risk and the company will not take any reponsibility for damage.

5.21 Signing as unchecked does not alter or affect the above terms

6. Returns and Refunds

6.1 Bespoke furniture orders cannot be cancelled after order confirmation. For all other furniture orders, you have the right to cancel within 14 days of delivery.

6.2 If you cancel your order after delivery for reasons other than faulty goods, return shipping costs must be covered by you.

6.3 A 30% non-refundable charge applies to all cancelled orders.

6.4 Issues with delivered furniture must be reported within 28 days. We will make up to three attempts to repair damaged furniture before offering an exchange or refund.

7. Guarantees

7.1 In addition to your statutory rights, we offer a one-year warranty on most furniture, covering faulty workmanship and materials. Some exclusions apply.

7.2 Guarantees are non-transferable.

7.3 Guarantees do not cover normal wear and tear, neglect, or damage caused by improper use or exposure to extreme conditions.

8. Claims Under Guarantee

8.1 To make a claim, contact us with your sales invoice number, address, and details of the issue.

8.2 We will repair defective goods free of charge. If repair is not possible, a replacement or refund will be offered.

8.3 We are not liable for financial loss beyond the value of the goods. This does not affect your statutory rights.

8.4 Our guarantees and warranties are limited to goods sold and retained in the United Kingdom (excluding Northern Ireland), and used solely for private and domestic purposes.

9. Online and Telesales

The following terms and conditions in this Clause 9 apply exclusively to purchases made through our Tele-Sales team or our website at www.­­desig­­ner­­sofas4u.­­co.­­uk. These conditions do not apply to purchases made in-store. However, for online and tele-sales purchases, the conditions outlined below shall apply:

9.1 Bespoke Orders

9.1.1 All furniture from our Chesterfield Sofa, Fabric Sofa, and Tub Chair ranges is made to your exact specifications. Once we have accepted your order, it cannot be cancelled.

9.1.2 A non-refundable deposit of at least 30% is required for us to accept any bespoke orders.

9.1.3 All calls made to our Tele-Sales team are recorded for monitoring, training, and quality assurance purposes.

9.2 Cancellations and Returns for Non-Bespoke Orders

9.2.1 For all other purchases, you have the right to cancel your order up to 7 days after the delivery date. All returned items must be in their original packaging (including bubble wrap). Items that are returned without their original packaging, or that have been assembled, will not be collected, and a charge of £25 may apply to cover the cost of failed collection.

9.2.2 Initial delivery charges are non-refundable unless the goods were damaged during delivery by our courier. A second delivery charge will apply for the collection of returned goods.

9.4 Online Sales Terms

9.4.1 Our website has been designed for your convenience. If you have any comments or queries, please contact us at info@designersofas4u.co.uk.

9.4.2 We strive to display product colours as accurately as possible on our website. However, we cannot guarantee that your device's display will perfectly reflect the actual colour of the product.

9.4.3 Some products and promotions are exclusive to online purchases and may not be applicable to in-store sales.

9.4.4 The contract between you and Designer Sofas For You is only concluded once we have received valid payment details and confirmed the order via email to the address provided during registration and ordering.

9.4.5 While we make every effort to ensure accuracy, prices and details may change, and errors may occur. We will correct any errors as soon as possible but cannot be held responsible for any losses arising from such errors.

9.4.6 We reserve the right to refuse any order placed with us.

9.4.7 To the fullest extent permitted by law, we exclude all warranties, express or implied, regarding the accuracy of information on the website. We accept no liability for any reliance placed on such information.

9.4.8 Any material downloaded from our website is at your own risk, and you are responsible for any damage to your computer or loss of data resulting from such downloads.

9.4.9 Our website is controlled and operated from England, and the laws of England and Wales govern any disputes relating to its use. If you access the website from outside England and Wales, you agree that any disputes will be governed by the laws of England and Wales.

9.4.10 As all furniture is made specifically for you, once delivered and signed for, it cannot be returned. In the event of damage caused by our courier during delivery, we will be responsible for repair, but no refund will be issued.

9.4.11 The above does not affect your statutory rights.

9.5 Delivery Terms (Tele-Sales and Online Orders)

9.5.1 Once your product has been manufactured or received, we will contact you to arrange a delivery date.

9.5.2 A delivery charge of £99 applies to the following postcodes: CA, DL, LA, LD, LL23-27, LL35-78, SA19-73, SY18-20, SY23-25, TS. For delivery to postcodes GY, HS, IM, IV14-29, IV37-63, JE, KA28, KW, PA20-PA24, PA34, PA36-78, PH17-50, ZE, charges will be provided upon request.

9.5.3 Standard delivery is a one-person service and occurs on weekdays to any mainland UK address accessible by our standard delivery vehicles (maximum weight: 10 tons; dimensions: 26 feet long, 9 feet wide, and 13 feet 6 inches high).

9.5.4 For non-standard deliveries, please contact us at info@designersofas4u.co.uk for a quote.

9.5.5 It is your responsibility to ensure that the furniture can be delivered to your room of choice. Our delivery charges do not include removal of doors, windows, or other fixtures if required for access.

10. Clearance Range

10.1 Payment must be made in full at the time of purchase for clearance items.

10.2 No refunds are available unless goods are faulty. The length of the guarantee is reduced to one year unless otherwise specified.

11. Applicable Law

These terms and conditions are governed by the laws of England and Wales. Any disputes will be subject to the jurisdiction of the English courts.
